 What happens if it goes wrong

Failure to comply with health and safety requirements can leave an employer’s business exposed to possible risk from a number of areas, for example:

  • Loss of essential personnel through injury or ill-health
  • Loss of plant and equipment following accidents or incidents
  • Enforcement authority action.  i.e., improvement/prohibition notices and prosecution together with the potential costs incurred from the Fee For Intervention (FFI) scheme run by the HSE
  • Civil action following accidents or incidents of ill-health

What could it cost?

At present unlimited fines and up to 2 years in jail can be levied by Crown Courts for guilty verdicts in health and safety prosecutions. In the Magistrates Courts maximum fines are up to £20,000 per offence and up to 6 months in jail.  The largest ever fine of £15 million was levied against Transco follwing myultiple fatalities in a 2005 domestic gas explosion in Scotland. Network Rail was fined £4.5 million follwing multiple casualties and 1 fatality in the Grayrigg train crash in 2007.

In England and Wales, the Health and Safety Executive operate the 'Fee for Intervention' scheme (FFI) - businesses who are found to be committing 'material breaches' of health and safety law can be made to pay for their shortcomings.  HSE levy a basic charge of £124 per hour - increasing substantially when experts are involved when dealing with material breaches.

Civil action claims following accidents and ill health at work are part of the compensation culture.  It's always somebody elses fault - or is it?
